What it takes to qualify

Worth a closer look

  • Participants must be entered in a relevant professional register, and for foreign persons in analogous registers according to the legislation of the member state where they are established.
  • When the participant is a producer of the proposed medicinal products, he must have an authorization for their production, in accordance with Article 196 of the ZLPHM or an equivalent authorization, in accordance with the legislation of the member state of the EU where the participant is established.
  • When the participant has an authorization for production or for wholesale trade, issued by the regulatory authority of another member state, he must submit: a) Authorization from the Executive Director of the IAL in the cases of Article 195, para. 2 of the ZLPHM or b) Declaration that he does not use warehouse premises on the territory of the Republic of Bulgaria – free text;
  • When the participant is an importer from a third country in the sense of § 1, item 76 of the Additional Provision of the ZLPHM – document that he is registered as a trader in accordance with the legislation of the member state of the EU and an import authorization issued by the Executive Director of the IAL, in accordance with Articles 161/164 of the ZLPHM or equivalent, issued by an authority established in another member state of the EU.
  • The documents with which the compliance with the requirements is proven and which must be presented under the conditions of Article 67, para. 5 and Article 112 of the ZOP are: - certified copy of the valid authorization for wholesale trade in medicinal products, issued by the IAL and valid license, when applicable, or equivalent, issued by an authority established in another member state of the EU, or other document, or information, admissible in accordance with the ZOP;
  • The documents with which the compliance with the requirements is proven and which must be presented under the conditions of Article 67, para. 5 and Article 112 of the ZOP are: - certified copy of the valid license under Article 32 of the Law for Control of Narcotic Substances and Precursors for wholesale trade, storage, import, export, transfer and transport of narcotic substances from the lists under Article 3, para. 2, item 2 and item 3 of the Law for Control of Narcotic Substances and Precursors or equivalent document issued by the regulatory authority of another member state of the EU, or other document, or information, admissible in accordance with the ZOP;
  • The candidate or participant has tax liabilities in the sense of Article 162, para. 2, item 1 of the Tax and Social Security Procedure Code and interest on them to the state or to the community at the seat of the contracting authority and the candidate or participant, or analogous liabilities in accordance with the legislation of the state where the candidate or participant is established, proven with a binding act of a competent authority (Article 54, para. 1, item 3 of the ZOP)
  • The candidate or participant has liabilities for mandatory insurance contributions in the sense of Article 162, para. 2, item 1 of the Tax and Social Security Procedure Code and interest on them to the state or to the community at the seat of the contracting authority and the candidate or participant, or analogous liabilities in accordance with the legislation of the state where the candidate or participant is established, proven with a binding act of a competent authority, (Article 54, para. 1, item 3 of the ZOP)
  • The candidate or participant has been sentenced with a binding conviction for a crime under Articles 194 – 208, 213a – 217, 219 – 252 and 254a – 255a and 256 – 260 of the Penal Code (Article 54, para. 1, item 1 of the ZOP); has committed violations under Articles 61, para. 1, 62, para. 1 or 3, 63, para. 1 or 2, 228, para. 3 of the Labour Code and under Article 13, para. 1 of the Law on Labour Migration and Labour Mobility, established with a binding penal decision or court decision (Article 54, para. 1, item 6 of the ZOP); circumstances under Article 3, item 8 of the Law on Economic and Financial Relations with Companies Registered in Jurisdictions with a Preferential Tax Regime, Controlled by Them Persons and Their Actual Owners; circumstances under Article 87 of the Law on Anti-Corruption
  • The candidate or participant has been established that he has tried to influence the taking of a decision by the contracting authority related to the exclusion, selection or award, including by providing false or misleading information, or has obtained information that may give him an unjustified advantage in the public procurement procedure.
  • There is a conflict of interest in the sense of § 2, item 21 of the DR on the ZOP that cannot be removed (Article 54, para. 1, item 7 of the ZOP)
  • There is an unequal treatment in the cases of Article 44, para. 5 of the ZOP (Article 54, para. 1, item 4 of the ZOP)
  • The candidate or participant has been established that: - he has submitted a document with false content, with which the declared lack of grounds for exclusion or the declared fulfillment of the selection criteria is proven; - he has not provided the required information related to the verification of the lack of grounds for exclusion or the fulfillment of the selection criteria (Article 54, para. 1, item 5 of the ZOP)
  • For the candidate or participant there is one of the following circumstances: he has been sentenced with a binding conviction for crimes under Articles 321 or 321a of the Penal Code (Article 54, para. 1, item 1, item 1 of the ZOP) or for an analogous crime in another member state or a third country (Article 54, para. 1, item 1, item 2 of the ZOP); he has been sentenced with a binding conviction for a crime under Articles 301-307 of the Penal Code (Article 54, para. 1, item 1, item 1 of the ZOP) or for an analogous crime in another member state or a third country (Article 54, para. 1, item 1, item 2 of the ZOP); he has been sentenced with a binding conviction for a crime under Articles 209-213 of the Penal Code (Article 54, para. 1, item 1, item 1 of the ZOP) or for an analogous crime in another member state or a third country (Article 54, para. 1, item 1, item 2 of the ZOP); he has been sentenced with a binding conviction for a crime under Article 108a of the Penal Code (Article 54, para. 1, item 1, item 1 of the ZOP) or for an analogous crime in another member state or a third country (Article 54, para. 1, item 1, item 2 of the ZOP); he has been sentenced with a binding conviction for a crime under Articles 253-260 of the Penal Code (Article 54, para. 1, item 1, item 1 of the ZOP) or for an analogous crime in another member state or a third country (Article 54, para. 1, item 1, item 2 of the ZOP); he has committed a violation under Articles 159a-159g of the Penal Code, established with a binding penal decision or court decision, or analogous violations, established with an act of a competent authority, in accordance with the legislation of the state where the candidate or participant is established (Article 54, para. 1, item 6 of the ZOP)
  • The candidate or participant has been established that he has tried to influence the taking of a decision by the contracting authority related to the exclusion, selection or award, including by providing false or misleading information, or has obtained information that may give him an unjustified advantage in the public procurement procedure. (Article 55, para. 1, item 5 of the ZOP)

Experience

  • At least 1 similar work — Turnover in the field of delivery of medicinal products.
  • Valid authorization for wholesale trade in medicinal products issued by the IAL or by the regulatory authority of another member state, in accordance with Chapter nine of the ZLPHM.
  • Valid license under Article 32 of the Law for Control of Narcotic Substances and Precursors for wholesale trade, storage, import, export, transfer and transport of narcotic substances from the lists under Article 3, para. 2, item 2 and item 3 of the Law for Control of Narcotic Substances and Precursors, or equivalent document issued by the regulatory authority of another member state.
