Spanish procurement glossary.

Spanish tenders follow the Public Sector Contracts Law (LCSP) and use a vocabulary of their own. This glossary explains the terms you’ll meet in a notice, the tender documents or an appeal, with what each means for a bidder.

The rules and the market

Term Meaning
LCSP Ley 9/2017 de Contratos del Sector Público, the Public Sector Contracts Law.
RGLCAP The 2001 implementing regulation, still in force where it doesn’t conflict with the LCSP.
Contrato sujeto a regulación armonizada (SARA) A contract above the EU thresholds, subject to the EU-derived rules.
Valor estimado (VE) The estimated value, excluding VAT, used to choose the procedure.
Órgano de contratación The contracting body.
Contrato menor A minor contract: under €40,000 (works) or €15,000 (supplies and services), awarded directly.

Procedures

Term Meaning
Procedimiento abierto Open procedure: anyone can bid.
Procedimiento abierto simplificado Simplified open procedure: works up to €2 million, supplies and services under €140,000. ROLECE registration is required.
Procedimiento sumario (abierto simplificado abreviado) The “super-simplified” procedure: works under €80,000, supplies and services under €60,000. 10 working days to bid, with no solvency proof or performance guarantee.
Procedimiento restringido Restricted procedure: candidates apply, and those selected bid.
Procedimiento negociado (con / sin publicidad) Negotiated procedure, with or without publicity. Without publicity, only in listed cases.
Diálogo competitivo / asociación para la innovación Competitive dialogue and innovation partnership.
Acuerdo marco Framework agreement, up to 4 years.
Sistema dinámico de adquisición Dynamic purchasing system.
Lote Lot. Contracts must be divided into lots where possible.

Finding and reading tenders

Term Meaning
PLACSP The Plataforma de Contratación del Sector Público, the national platform that aggregates regional ones.
Perfil de contratante The buyer profile, where a tender legally lives and where you bid.
Anuncio de licitación Contract notice.
Pliegos (PCAP / PPT) The tender documents: administrative clauses, and technical specifications.
Criterios de adjudicación Award criteria, based on the best quality-price ratio.

Qualifying and bidding

Term Meaning
DEUC Spain’s version of the European Single Procurement Document.
Declaración responsable A sworn self-declaration.
ROLECE The Official Register of Bidders and Classified Companies. It proves your capacity, solvency and classification to all public buyers.
Clasificación Contractor classification by group, subgroup and category. Mandatory for works of €500,000 or more. EU firms are exempt; non-EU firms aren’t.
Solvencia (económica / técnica) Financial and technical standing. By default, turnover of 1.5 times the contract value.
UTE (unión temporal de empresas) A temporary joint venture. Members are jointly and severally liable, and no deed is needed until award.
Integración de solvencia con medios externos Relying on another company’s capacity.
Subcontratación Subcontracting. There’s no legal percentage cap.
Garantía provisional Bid guarantee: exceptional, and at most 3%.
Garantía definitiva Performance guarantee, normally 5% of the price excluding VAT.
Informe de reciprocidad (art. 68) The reciprocity report for non-EU firms. Since July 2025, the State advisory board recommends buyers stop asking for it.
Sobre Envelope: bids are submitted in separate electronic envelopes for documents, criteria and price.
Oferta anormalmente baja / baja temeraria An abnormally low bid, which must be justified.
Condición especial de ejecución A special performance condition (social, environmental or innovation), mandatory in every contract.

Challenges and after the award

Term Meaning
Recurso especial en materia de contratación The special appeal: works over €3 million, supplies and services over €100,000. Free, with 15 working days to file.
TACRC The Central Administrative Tribunal for Contract Appeals. Many regions have their own tribunal.
Adjudicación / formalización Award, then formal signature of the contract.
Plazo de pago Payment: 30 days to approve, then 30 days to pay. Late-payment interest is 10.40% (second half of 2026).
FACe The public e-invoicing hub, mandatory for foreign companies too.
OIReScon The independent procurement supervisory office, which publishes annual statistics.

Questions

What is a contrato menor in Spain?

A minor contract: under €40,000 for works or €15,000 for supplies and services, excluding VAT. The buyer can award it directly to any capable company, for up to one year with no extension; minor contracts are published quarterly after the event.

What are the pliegos?

The tender documents: the pliego de cláusulas administrativas particulares (PCAP) sets the legal and administrative conditions, award criteria and documents required; the pliego de prescripciones técnicas (PPT) sets the technical specifications.

What is a baja temeraria?

The informal term for an abnormally low bid (oferta anormalmente baja). The tender documents set the parameters; a bidder flagged as abnormally low must justify its price, and its bid can be rejected if the justification fails.
