• The successful firm should submit the AMC certificate for 5 year after the warranty period (1 year warranty plus 5 year AMC)
• Unlimited breakdown will cover under AMC and problem shall be resolved within 24 hours. One wet service and one dry service yearly will also be covered under AMC
• The department reserves the right at the time of award to increase or decrease the quantity/size of units and services originally specified in the tender document without any change in unit price or other terms and conditions
• The successful bidder shall supply the complete design of onsite installation/ constructions to the CEO, 'Pear Estate, Amritsar' for approval before to start the work
• The successful bidder shall supply and install all the equipment's along with suitable lab furniture as required
• Department has right to get tested any items used in the work at any time and firm shall have to bear this testing cost
• Successful bidder shall have to provide the letter from OEM (Original Equipment Manufacturer) for the equipment's or a part thereof procuring from the manufacturer
• Successful bidder will sign MOU with Pear Estate for carrying out the work
• Successful bidder will be responsible for deduction of TDS under Income Tax and TDS under GST as per financial guidelines of State/Centre Govt
• The successful tenderer shall warrant that material to be supplied shall be free from all defects and faults, workmanship, manufacture and shall be of the highest grade
• The guarantee/warranty period shall start from the date of final inspection done by authorized inspection committee
• Successful firm shall have to provide the guarantee/warranty certificate before the release of last installment as per payment terms described above
• If CEO, Pear Estate, Amritsar notices that the work is not progressing as per given specifications and there are violations of the terms and conditions of the tender he/she has every right to give stop memo and terminate the contract without prior notice and reserves the right to blacklist the firm along with the forfeiture of EMD and bank guarantee of the firm
• Final decision in all issues arising in connection with the tender process and execution of work shall be taken by the CEO, Pear Estate, Amritsar and the said decision shall be binding upon all
• If any dispute or difference of any kind shall arise between the Department and the firm in connection with this tender/contract, the parties shall make every effort to resolve the same amicably by mutual consultations. Otherwise, the disputes shall be referred to the sole arbitration of the Deputy Director, Department of Horticulture, Amritsar Punjab and his award shall be final and binding on the parties to the dispute. All disputes relating to the tender shall exclusively be subject to jurisdiction of court in Amritsar (Punjab)
