Worth a closer look

• § 130a Abs. 8 SGB V enables health insurance funds and pharmaceutical companies to conclude framework discount agreements for medicinal products to be charged to the statutory health insurance funds.
• In view of the relevant statutory regulations for awarding public contracts, a regular process of substance-related, formal procurement procedures according to the regulations of the 4th Part of the GWB is carried out by the DAK-Gesundheit.
• The DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to a lack of selection decision and thus the non-discriminatory access of all pharmaceutical companies.
• To do justice to the diversity of potential contracting partners within the framework of the approval model, each pharmaceutical company will be enabled during the term of the contract to conclude a framework agreement at any time and under the same conditions.
• The necessary contractual documents are available for download via the online portal www.dtvp.de/center under the link named under 5.1.11.
• The offer is to be submitted in text form as an electronic offer via email to openhouse@dak.de.
• The submission of the offer by post is not provided for in this procedure.
• Please do not submit the offer via the German Procurement Portal.
• For the observance of the deadline, an electronic receipt of the complete documents via email to the address openhouse@dak.de is sufficient.
• Later participations are possible at any time.
• In order to join on the 1st or 15th of the following month during the term of the contract, the above-mentioned documents must be with the DAK-Gesundheit by the 5th of the preceding month, regardless of the desired participation.
• Example: If the bidder's desired participation is to take place on 15.07 (following month), the documents would have to be with the DAK-G by 05.06 (preceding month).
• Note: The publication is made here using the form for open procedures.
• As already clearly stated, this is such a non-exclusive agreement - the notice had to be used for technical reasons as there is no suitable form for approval procedures.
