This guide is the checklist behind an Italian bid: every document and step, in the order a tender asks for them, with who can lawfully do each one. For how Italian procurement works overall (thresholds, procedures, how bids are assessed, getting paid), see How to bid for public contracts in Italy.
Before you bid
1. Your company’s registration and tax identifiers. Buyers check your entry in the Registro delle Imprese at the Chamber of Commerce, which shows your corporate object, legal representatives and procuratori; platforms prefill company data from InfoCamere. A visura camerale comes the same day, reflects current data, and anyone can order it online: the register is public. Italian firms hold a codice fiscale and partita IVA from the Agenzia delle Entrate from incorporation (free, permanent).
- From abroad: a home-country professional or trade register extract takes the place of the visura, with a sworn Italian translation, and an apostille if you are from outside the EU. You don’t need Italian tax identifiers to register and bid on Acquisti in Rete: answer “No” to Italian VAT and give your home identifier. You may need them to perform or invoice in Italy; a commercialista files the identification as your appointed representative (direct identification for EU firms, a fiscal representative for non-EU firms), and you sign the appointment.
2. A certified email address (PEC). The PEC is the legal channel for communications, MePA requires one, and buyers send notices to it. It comes from an AgID-accredited provider at market price, the same day, as an annual subscription. You own the mailbox; you can give your adviser read access so nothing is missed. Foreign companies can get one from an Italian provider.
3. A digital identity for every user. Acquisti in Rete and ANAC’s services require each person to log in with their own identity: SPID, CIE, CNS or eIDAS. It costs nothing or little and takes from the same day to a few days.
- Who does it: each person (your legal representative, any Collaboratore, any adviser) verifies their own identity. Nobody logs in as someone else.
- From abroad: use eIDAS where your country supports it. Otherwise, Consip’s sign-up route takes a passport, an alternative ID number, a short video interview in Italian or English and Microsoft Authenticator; ANAC gives users without a codice fiscale credentials with a one-time code.
4. A qualified electronic signature (firma digitale). Offers, the DGUE, declarations and the MePA enablement are signed with a qualified signature from a provider on the EU trusted lists, and the identity in the signature must match the one registered. It costs a market price, takes days, and the certificate typically lasts 3 years.
- Who does it: your legal representative, or a procuratore with a notarial procura, obtains and keeps their own.
- From abroad: any eIDAS qualified signature from an EU trusted-list provider works, also for non-EU firms. Signatures from other providers are rejected.
5. A notarial procura, if someone other than the legal representative signs. Where the signer is a procuratore, the bid includes a copy of the notarial procura, or the visura showing it.
- Time and validity: 1–3 days; valid until revoked.
- Who does it: an avvocato drafts it, your legal representative grants it before a notaio, and the procuratore (one of your employees, or an avvocato) then signs with their own qualified signature.
- From abroad: a foreign notarial procura with an apostille and a sworn translation.
6. Register on the platforms. Since 1 January 2024 every procedure runs on an ANAC-certified platform connected to the national public contracts database (BDNCP), and each platform has its own registration.
- Acquisti in Rete (Consip): needed for Consip tenders, MePA and SDAPA. Free, the same day, though identity checks can add days for the foreign sign-up. Each user registers personally. Conventions and framework agreements need only this registration.
- MePA or SDAPA enablement (abilitazione): your legal representative chooses the categories, signs the declarations with their own qualified signature and gives a PEC. Free. The declarations don’t expire but must be kept up to date, and your catalogue counts as a binding offer. The legal representative can then appoint Collaboratori, who prepare tender applications and manage orders and the catalogue under their own login. The full MePA process is in our guide to SOA qualification and the MePA marketplace.
- The buyer’s certified platform (Sintel-ARIA, START, EmPULIA, SATER and others): registration is typically free and takes from the same day to a few days; your legal representative or procuratore signs the registration declarations, and further users are added under each platform’s rules.
7. Sector qualifications for works and sensitive sectors.
- SOA certificate, for works of €150,000 or more. You sign a contract with an SOA body authorised by ANAC; an engineer or consultant compiles your works certificates (CEL), staff costs (at least 15% of turnover) and equipment (at least 2%); your legal representative signs the contract and declarations. The SOA issues it within 90 days of the contract, with one possible suspension of up to 90 days. Its fee follows a formula with a coefficient set every year. It lasts 5 years, with a verification at year three that you request at least 90 days before the deadline. ISO 9001 is needed above class II.
- Works under €150,000: no SOA; you declare similar works performed, staff cost and equipment, backed by certificates from your clients.
- The prefecture white list. Firms in activities exposed to mafia infiltration, such as earth transport, waste, concrete, quarrying and site guarding, must be on the white list of the prefecture where they are registered (Law 190/2012) to contract. Free; valid 12 months and renewable. A lawyer or consultant prepares the application; your legal representative signs it.
With your bid
8. The DGUE. Your self-declaration on exclusion grounds and requirements, filled in on the platform and signed by your legal representative or procuratore with their qualified signature. Free; valid for that procedure. In a joint bid (RTI) each member files one, and so does any firm whose capacity you rely on.
9. Fees, where the tender calls for them.
- The ANAC contribution, owed when the tender is above ANAC’s minimum value. It depends on the estimated contract value excluding VAT, options included, and the amount is fixed by the ANAC resolution in force when the tender is published. The payment notice is generated in ANAC’s Gestione Contributi Gara service and paid through ANAC’s payment portal, the same day. Anyone can pay it for you with the CIG and your fiscal code. Attach the receipt to the bid; it is valid for that CIG.
- Stamp duty (imposta di bollo), where the disciplinare asks. Many tenders require €16 of stamp duty per document on the application or the economic offer, paid through F24 or pagoPA. Your commercialista or adviser can pay it with your code and upload the proof. Foreign operators pay by bank transfer or F24, as the disciplinare allows.
10. The provisional guarantee (garanzia provvisoria), where the bando requires it. A cash deposit, or a digitally signed fideiussione from a bank, an insurer or a financial intermediary registered under article 106 of the TUB. It follows the ministerial model, waives preventive enforcement against you and the defence under article 1957, is payable within 15 days, must be verifiable online with the issuer, and stays valid for at least 180 days from submission. It goes in the administrative envelope. You sign the facility. EU banks and insurers meeting these requirements can issue it.
11. Joint bids and borrowed capacity. Relying on another firm’s capacity (avvalimento) needs a contract that specifies the resources lent. A joint bid needs a commitment to form an RTI and, after award, a collective mandate with representation drawn up by a notaio as a public deed or an authenticated private deed. An avvocato drafts these; each party signs with its own qualified signature.
12. Submitting. The administrative, technical and economic envelopes are uploaded on the certified platform before the deadline. A Collaboratore or delegated user can prepare and upload them; your legal representative or procuratore signs each document with their own qualified signature and confirms the submission where the platform requires it. The offer stays valid for the period the bando sets, typically 180 days.
If you’re in line for award
The buyer verifies most of your requirements itself through the FVOE 2.0 (Fascicolo Virtuale dell’Operatore Economico), ANAC’s file in the BDNCP, and may not ask you again for documents already in it (article 99). You upload only what isn’t there, through your authorised user, who logs into ANAC’s services with their own SPID, CIE, CNS or eIDAS, or with ANAC’s credentials and one-time code if they are foreign.
| Check | Issued by | Who handles it | Valid for | What only you do |
|---|---|---|---|---|
| DURC (social-security contribution regularity) | INPS, INAIL and, for construction, the Casse Edili (DURC On Line) | The buyer fetches it; a consulente del lavoro or commercialista can request it as your intermediary | 120 days; immediate if regular, up to 30 days if checks are needed | Keep contributions regular |
| Tax regularity | Agenzia delle Entrate | The buyer checks it through the FVOE; a commercialista resolves any issue | — | — |
| Criminal records of the persons listed in article 94(3), and the company’s administrative-offence register | Ministry of Justice (casellario giudiziale) | The buyer checks them | — | Give the names of the relevant persons |
| Experience for services and supplies (similar contracts, turnover) | Your former clients: certificates from public clients, invoices or declarations from private ones | Collected for you and uploaded to the FVOE or platform | — | — |
| Register entry | Chamber of Commerce | Anyone can order the visura | Current data | — |
The DURC matters at every stage: the buyer checks it before award and again at each payment. Definitively established tax violations are an exclusion ground (articles 94-95), which is why tax regularity is checked.
When the tender asks for them: ISO 9001 and the other certifications listed in the Code (ISO 14001, 45001, 27001, SA8000 and others), from an ACCREDIA-accredited body or one accredited in another EU state. They take 2–6 months and last 3 years with surveillance audits. ISO 9001 gives a 30% reduction of the guarantees, and the other listed certifications up to 20% more where the tender documents say so.
Before the contract and the first invoice
The performance guarantee (garanzia definitiva, article 117). Issued by a bank, insurer or article 106 TUB intermediary on the ministerial model, with the same reductions as the provisional guarantee. In an RTI the lead company submits it for all members. It is released progressively, up to 80%, and the remainder lasts until the certificate of regular execution, at most 12 months after completion. You sign the facility.
Insurance. Works contractors provide all-risk (CAR) and third-party liability insurance, and designers professional indemnity, from insurers authorised by IVASS, for the duration of the contract. A broker or insurer issues it; you sign the policy. EU insurers can provide it under the freedom to provide services.
Anti-mafia checks (D.Lgs. 159/2011). For contracts from €150,000 the buyer requests a comunicazione antimafia, and above the EU thresholds an informazione antimafia, from the prefectures through the national anti-mafia database (BDNA). The informazione takes up to 30 days, extendable. A comunicazione is valid 6 months, an informazione 12 months. Each relevant person signs their own declaration listing the family members living with them. An interdictory notice excludes you and costs you the guarantee.
The traceability declaration (Law 136/2010). You declare a dedicated bank account and the persons authorised to operate it, within 7 days of opening it or first using it for the contract; every payment carries the CIG. Your legal representative signs it.
The contract. Signed by your legal representative once the garanzia definitiva, insurance, traceability declaration and anti-mafia declarations are in.

| Tender consultant | Unregulated | Find notices, prepare the DGUE, technical offer and administrative envelope; work as a Collaboratore on Acquisti in Rete or a delegated user on other platforms |
If your company is from abroad
You don’t need an Italian company to bid, but for works of €150,000 or more a firm from a country without an EU agreement usually needs an Italian company or branch, a joint bid with an SOA-certified Italian firm, or reliance on its SOA; who may bid from abroad, and on what terms, is explained in How to bid for public contracts in Italy. For the paperwork:
- Identity and tax: a home register extract instead of the visura; no Italian VAT number needed to register and bid (see step 1).
- Logins and signature: eIDAS, or Consip’s sign-up and ANAC’s one-time-code routes; a qualified signature from an EU trusted-list provider; a PEC from an Italian provider.
- Works qualification: EU and agreement-country firms prove the SOA-equivalent requirements tender by tender with translated documents; there is no explicit route for a firm based abroad to hold its own SOA.
- Contributions: without Italian employees you give your home-state equivalent of the DURC or a self-declaration; posted workers need A1 forms.
- Tax and criminal records: a home-state tax certificate, and home-state criminal records for the relevant persons, apostilled and translated when asked.
- Anti-mafia: the checks apply to the relevant persons of foreign firms with Italian operations, with documents as each prefecture requires.
- Translations: qualification documents need a sworn Italian translation (traduzione asseverata), with stamp duty on the sworn attestation, and non-EU public documents need an apostille or legalisation.
Pitfalls
- Never hand over your SPID, CIE, CNS, firma digitale or platform login. Your legal representative, every Collaboratore and every adviser works under their own identity.
- Only the legal representative can submit and complete the MePA enablement. Advisers come in afterwards, as Collaboratori.
- A procuratore needs a notarial procura. Upload it with the bid, or make sure the visura shows it.
- Check your signature provider. Only qualified signatures from EU trusted-list providers are accepted, and the identity in the signature must match the registered one.
- A firm you rely on can’t bid against you. An auxiliary firm in an avvalimento cannot also bid in the same procedure.
- Guarantees must be verifiable online. Fideiussioni must be digitally signed and come only from banks, insurers or 106 TUB intermediaries.
- Don’t let the SOA lapse. Request the three-year verification at least 90 days ahead; if it finishes late, you can’t bid until it is approved. The certificate itself expires after 5 years.
- Start translations early. Foreign documents need a sworn Italian translation and, where applicable, an apostille or legalisation.
- Your lawyer can’t also advise a competitor. An avvocato may not assist competing bidders in the same procedure.
- Use the regulated profession. Out-of-court legal advice given continuously, systematically and in an organised way is reserved to avvocati (Law 247/2012, art. 2(6)), and labour and social-security compliance work for others to consulenti del lavoro and a few other orders (Law 12/1979).
Doing it with askTender
In Italy, your askTender Partner is added as a named user on your company’s account on Acquisti in Rete (MePA) and the buyers’ platforms and works under their own login. You keep your own login, and sign what only you can sign: the enablement, the DGUE and declarations, every document of the offer, the procura and the guarantee facilities. The askTender Desk prepares the DGUE and declarations, assembles the envelopes, pays the ANAC contribution and stamp duty and coordinates the certificates; askTender Partners, such as an avvocato, a commercialista, a consulente del lavoro or a translator, do the steps their licence covers.
Questions
Which documents do I submit with a bid in Italy?
The DGUE, Italy’s version of the European Single Procurement Document, signed with a qualified electronic signature, together with your administrative, technical and economic envelopes. Depending on the tender you add the receipt for the ANAC contribution, proof of stamp duty, the provisional guarantee, the notarial procura if a procuratore signs, and any joint-bid or avvalimento documents.
Do I need a qualified electronic signature to bid in Italy?
Yes. Offers, the DGUE, declarations and MePA enablement are signed with a qualified electronic signature (firma digitale) from a provider on the EU trusted lists, and the identity in the signature must match the registered one. Non-EU companies can use any eIDAS qualified signature from such a provider; signatures from other providers are rejected.
Can a consultant bid on my behalf on MePA?
A consultant can prepare tender applications and manage orders and the catalogue once your legal representative appoints them as a Collaboratore; they work under their own login. The enablement itself must be submitted and completed by the legal representative, and documents are signed by the legal representative or by a procuratore holding a notarial procura, each with their own signature.
How long is a DURC valid?
120 days. It certifies that INPS, INAIL and, for construction, Cassa Edile contributions are regular. The buyer fetches it online before award and at each payment; it is immediate if you are regular, and can take up to 30 days if checks are needed.
What is the FVOE?
The Fascicolo Virtuale dell’Operatore Economico, ANAC’s virtual company file. Buyers use it to verify exclusion grounds and requirements with the certifying bodies, and they cannot ask you again for a document already in it. You upload only the documents you have to produce yourself.
When do anti-mafia checks apply?
For contracts above the D.Lgs. 159/2011 thresholds: a comunicazione antimafia from €150,000 and an informazione antimafia above the EU thresholds. The buyer requests them through the national anti-mafia database; each relevant person signs a declaration listing family members living with them. A comunicazione is valid 6 months and an informazione 12 months.
