Every step to bid in Moldova.

A Moldovan bid is valid only if every document carries a qualified electronic signature, applied by your administrator or by an employee holding a procură published with the offer. Everything else can be prepared for you: the profile on an MTender platform such as achizitii.md, the DUAE, the offers and the experience lists. Registration is free; a commission is charged on the lot value. If you are ranked first, updated supporting documents can be due within 3 working days, so keep the State Fiscal Service certificate and your register extract within reach.

This guide is the checklist behind a bid in Moldova: each document and step in the order a tender asks for it, and who is allowed to handle it. How Moldovan procurement works overall, from the two laws and thresholds to evaluation and complaints, is covered in How to bid for public tenders in Moldova.

Before you bid

1. Your company’s registration data. The extract from the State Register of Legal Entities, issued by the Public Services Agency (ASP), gives your IDNO (fiscal code), administrator and legal address. It feeds the platform profile, the platform may ask for it to confirm your identity, and it serves later as supporting evidence. The data is collected for you; you provide or order the extract.

2. Register on a certified MTender platform. You work through one of the certified platforms connected to MTender: achizitii.md (run by Simpals SRL), e-licitatie.md or yptender.md. Create a user account, set up your organisation’s Cabinet as Furnizor, complete the profile and sign the platform’s collaboration contract; the platform then checks and activates the account.

  • Cost: registration is free. The platform charges a participation commission on the lot value.
  • Time: verification runs Monday to Friday, 09:00–17:00, and a registration request stays valid for 14 days.
  • Signing the contract: Moldovan residents sign it electronically through MSign. Non-residents print two copies, sign and stamp them, e-mail a scan and post the original to Chișinău within 14 days, because the platform can’t currently verify foreign electronic signatures on it.
  • Who does it: the profile is filled in for you, and you confirm your own account e-mail. Your administrator signs the contract, or someone holding a procură does.

3. A qualified electronic signature for whoever signs. Every document you upload, and later the contract, must carry a qualified electronic signature; unsigned documents mean disqualification. Signatures come from Moldovan qualified providers and are applied through MSign or the MoldSign Desktop Suite.

  • Valid: as long as the certificate.
  • Who does it: your administrator, or an authorised employee, with their own signature. Nobody else holds the signature or its PIN.
  • From abroad: Moldovan law recognises EU qualified signatures (GD 491/2022). Confirm with your platform that it accepts yours before you rely on it for bid documents.

4. A procură, if an employee signs. When the signer isn’t the administrator, a power of attorney (procură) must be published with the offer; an internal order or job description isn’t enough. It names the administrator and the employee and covers signing the offer, taking part in the auction and answering clarifications. One per procedure is preferred, though it can run for up to a year. If the employee’s certificate doesn’t link them to their position, add an official electronic document showing the link. It can be drafted for you the same day; your administrator signs it electronically.

With your bid

5. The DUAE. The European Single Procurement Document, called the DUAE in Moldova, is your electronic self-declaration on exclusion, qualification and selection criteria. Use the form the buyer set: a missing DUAE, or the wrong form, means disqualification. It is free, can be reused while it stays accurate, and must declare any third party whose capacity you rely on. It is completed for you; you confirm it and sign it with your qualified signature.

6. Experience evidence, where the tender asks. List similar supplies, services or works with confirmation; for works, add good-execution certificates (certificat de bună execuție) from previous customers. A consultant compiles the list; you provide the certificates and sign it. Foreign certificates need a Romanian translation.

7. Financial capacity, where the tender sets criteria. You declare turnover and other economic and financial criteria in the DUAE and back them with financial statements for the last financial year if asked. Your accountant prepares them.

8. A consortium agreement, for a joint bid. A consortium (asociere) can bid without forming a company; a legal form can be required only after award. A lawyer drafts the agreement and each member signs it electronically.

9. The bid guarantee, where required. It can be up to 2% of the value excluding VAT, and must be submitted with the offer in exactly the form the tender documents state. A missing guarantee means rejection, with no chance to fix it. One guarantee may cover several lots.

  • Form: a bank guarantee, a transfer, a surety or a standby letter of credit. Under Law 325, licensed foreign banks may issue it in a foreign currency.
  • Cost: the bank’s fees.
  • Who does it: you contract the guarantee. Its form and amount are checked for you, and if another form would suit you, it can be requested in the clarification phase.

10. Romanian translations. Each notice lists the languages allowed, and in practice that means Romanian. Unless the notice allows another language, foreign documents go in Romanian translation.

11. Upload the signed offer. Upload the signed PDFs before the deadline; late bids are rejected automatically. Documents are published in a set order: the commercial offer, then qualification and technical documents, then the rest (the guarantee and the DUAE). To change a document, mark it anulat and publish the new one. Check every signature on msign.gov.md before the deadline, because a “digitally signed” label on a PDF proves nothing.

  • Who does it: a consultant uploads under their own Cabinet user; your administrator or authorised employee signs each document.

If you’re in line for award

12. The e-auction. In lowest-price procedures with at least 2 offers, MTender runs an e-auction: three rounds of about one minute each, with the lowest bidder bidding last. The final price becomes the contract price, and unit prices are updated afterwards. The person authorised under your procură takes part; you set the price limits.

13. Updated supporting documents. The DUAE was preliminary evidence, so the top-ranked bidder is now asked for updated supporting documents, sometimes within 3 working days (1 in the simplified procedure). Everything you send carries your qualified signature.

Evidence Issued by Who can get it for you Valid for What only you do
Certificate on the absence of tax debts State Fiscal Service (SFS) Your accountant keeps filings current and settles any debts; if debts remain, a certificate showing them may be accepted with proof of an instalment arrangement or payment — Request it through your own SFS electronic services or in person
State Register extract (IDNO, administrator, legal address) Public Services Agency (ASP) The data is collected for you — Provide or order the extract
Financial statements Your company Your accountant prepares them Last financial year —

Before the contract

14. The performance guarantee, where required. Under Law 325 from 2027 it is capped at 10% of the contract value; under Law 131 it is reported at up to 15%. It runs for the contract term. A bank or surety issues it for its fees; you contract it.

15. Sign the contract through MSign. After the standstill of 11 days (16 if the notice was not electronic), the buyer signs first and then you sign electronically through MSign. The contract is registered with the Treasury. Your contract representative, delegated by internal order or power of attorney, signs.

If your company is from abroad

You don’t need a Moldovan branch or company: you register directly on a certified MTender platform and bid, as set out in How to bid for public tenders in Moldova. For the paperwork:

Your home-country registry data and tax ID take the place of the State Register extract, and the platform may ask for supporting documents. You sign the platform contract on paper and post it. For the bid itself, an EU qualified signature is recognised in law, subject to your platform’s confirmation. Instead of the State Fiscal Service certificate, give your home-country tax certificate, translated; for other supporting documents, the home equivalents, or a sworn statement where none exist (Law 325). Experience certificates and financial statements from home go in Romanian translation. Guarantees may come from a licensed foreign bank in a foreign currency.

Pitfalls

  • Never share your platform login, MSign signature or PIN. Sharing credentials puts all the risk on you; a consultant works under their own Cabinet user.
  • Verify each signature before the deadline. Every offer document needs a valid qualified signature by the administrator or a procură-holding employee; check it on msign.gov.md.
  • Copy the guarantee form exactly. A guarantee in the wrong form, or a missing one, can’t be cured later.
  • Be ready for a 3-day turnaround. Missing documents can be due in 3 working days, or 1 in the simplified procedure.
  • Check which law governs the tender. Procedures launched before 1 January 2027 stay under Law 131/2015.

Doing it with askTender

In Moldova, your askTender Partner is added as a named user on your company’s account on the MTender platforms and works under their own login. You keep your own login, and sign what only you can sign: the platform contract, every offer document with your qualified signature, the procură and the contract itself. The askTender Desk prepares the DUAE, the offers, the experience lists and the evidence pack; askTender Partners, such as an avocat or an accountant, do the steps their licence covers.

Questions

Which documents go in with a bid in Moldova?

The DUAE in the form the buyer set, your technical and financial offers, experience lists with confirmations where the tender has experience criteria, the bid guarantee in the exact form the documents require, a procură if an employee rather than the administrator signs, and a consortium agreement for a joint bid. Every PDF carries a qualified electronic signature.

Who may sign a Moldovan bid?

Your company’s administrator, or an employee authorised by a procură that is published with the offer and covers signing the offer, taking part in the auction and answering clarifications. An internal order or job description isn’t enough. A consultant can prepare and upload the files under their own platform user but doesn’t sign them.

How does a foreign company register on an MTender platform?

It creates a user account and a supplier Cabinet, fills in the profile with its home registry data and tax ID, and signs the platform contract on paper: two copies printed, signed and stamped, a scan e-mailed and the original posted to Chișinău within 14 days. The platform then verifies and activates the account.

What happens if I’m ranked first?

In lowest-price procedures with at least 2 offers there is first an e-auction of three rounds of about one minute each. The buyer then asks the top-ranked bidder for updated supporting documents, such as the State Fiscal Service certificate on the absence of tax debts, sometimes within 3 working days (1 in the simplified procedure).

Can the bid guarantee come from a foreign bank?

Yes. Under Law 325, guarantees in a foreign currency from a licensed foreign bank are accepted. The guarantee can be up to 2% of the value excluding VAT and must match the form set in the tender documents exactly; if another form suits you better, ask during the clarification phase.
