How filing works in Brazil

You work on the portal under your own login. In Brazil, the client adds you as a named user on its account on Compras.gov.br: you prepare, upload and, on the client's written go-ahead, submit under your own login.

The client keeps its own login, the administrator role and every signature only it may give. You never use its credentials.

Rules we follow in Brazil

• Contador (accountant registered with a Conselho Regional de…. Technical accounting work (books, balance sheets, statements) is reserved to registered accounting professionals (Decreto-Lei 9.295/1946 art. 25; Civil Code art. 1.182 and 1.184 §2). The accountant signs under their own CRC registration and own digital identity, never the client's. CFC ethics rules on fee-sharing and solicitation were not checked (see notes).
• Advogado (lawyer enrolled with the Ordem dos Advogados do Brasil, OAB). Legal consultancy, advice and court work are reserved to lawyers (Lei 8.906/1994 art. 1). Lawyers may not solicit or 'capture' cases through third parties (art. 34 IV), and law firms may not have non-lawyer partners or do non-legal work (art. 16), so a platform cannot share legal fees or sell legal advice as its own product; the client contracts and pays the lawyer directly.
• Tabelião de notas / Oficial de Registro de Títulos e Documentos…. Notaries have exclusive competence for public deeds, powers of attorney, signature recognition and certified copies (Lei 8.935 art. 7); fees (emolumentos) are set by state tables. A foreign company's own power of attorney is normally notarised and apostilled in its home country.
• Tradutor e intérprete público (sworn translator, 'tradutor…. Translating any document that must be presented in another language to a Brazilian public body is a private activity of the public translator, and no translation has public faith unless made by one (Lei 14.195 arts. 26–27). Must be Brazilian or a foreigner resident in Brazil, passed the aptitude exam and registered with a Junta Comercial (art. 22). Fees follow each Junta's table (not checked).
• Assessoria / consultoria em licitações (bid consultant, 'analista de…. Not a regulated profession. Cannot give legal advice or sign appeals as legal work (reserved to OAB lawyers). The bidder stays legally responsible for every act done in its name by its representative (IN SEGES/ME 73/2022 art. 13 III), so the consultant must work only within written client instructions. Must never operate with the client's own gov.br password or certificate.
• Engenheiro / arquiteto registered with CREA (or CAU for architects). Engineering acts must be done by a registered professional who signs the ART personally. CONFEA/CREA treat 'renting' or assigning technical acervo between companies as fraud. A foreign company only has to show it has applied for CREA registration when it signs the contract (Lei 14.133 art. 67 §7).
• Seguradora (SUSEP-authorised insurer issuing seguro-garantia) or…. A bank guarantee must come from a bank authorised to operate in Brazil by the Banco Central (Lei 14.133 art. 96 §1 III); a foreign bank's guarantee alone does not qualify. The client is the policyholder (tomador) and signs the counter-guarantee itself. Insurance brokers (corretores, SUSEP-registered) may arrange it; their commission rules were not checked.
• Organismo de certificação acreditado pelo Inmetro (product,…. Must be accredited by Inmetro, or by a body Inmetro recognises, for the certificate to be accepted; independence rules apply (it cannot consult for the company it certifies).
• Representante legal no Brasil / procurador of a foreign supplier…. Powers come only from the foreign company's own power of attorney (notarised and apostilled abroad, sworn-translated, and registered at a Títulos e Documentos registry to take effect before public bodies). If the representative gives legal advice, they must be an OAB lawyer.
